Durant els últims anys de la bombolla immobiliària, del 2006 al 2009, quan la crisi era imminent, les entitats financeres van comercialitzar, entre altres productes, les anomenades hipoteques multi divisa. Anys després els tribunals han hagut de pronunciar-se davant les denúncies dels més de 60.000 afectats a Espanya. Però, què és una hipoteca multi divisa?, i per què és dolenta? Una hipoteca multi divisa, és aquella que permet pagar el deute contret amb el banc amb la divisa estrangera que el client esculli. I per què algú voldria pagar la seva hipoteca, per exemple, amb iens japonesos? Perquè es venia com que d’aquesta manera, l’hipotecat s’estalviava l’euríbor. El que no sabien és que s’estaven condemnant.
En la venda d’aquest producte, els bancs venien els avantatges de reduir el tipus d’interès, però sense informar del risc de dependre de la fluctuació d’una divisa estrangera, ni del fet d’apostar contra la devaluació de l’euro en plena crisi econòmica.
En comprar una casa a Barcelona, per exemple, contractant una hipoteca multi divisa, el client contracta la hipoteca en euros però les quotes i l’amortització es recalculen periòdicament en la divisa triada. Tot el que baixi l’euro enfront de l’altra divisa suposa una pèrdua per al client. Resumint: Podia donar-se el cas que, després d’haver pagat les quotes durant anys, el client degui en euros molt més dels diners rebuts en contractar la hipoteca. Un absurd, veritat?
Es podria tenir la temptació de pensar que aquells els qui la van contractar sabien que corrien un risc, no obstant això, el Tribunal Superior de Justícia els ha donat la raó en considerar que les hipoteques multi divisa no són un préstecs hipotecari comú sinó un complex derivat financer, d’abast internacional, del que ha d’informar-se al client amb rigor, segons ho indica Llei del Mercat de Valors.
En altres paraules, faria falta tenir coneixements avançats sobre el funcionament del mercat de divises a futurs, cosa que pràcticament solament saben els professionals que per la seva activitat, han d’estudiar el comportament dels mercats internacionals i les divises que regeixen l’economia mundial, per poder fer-se la idea del risc d’aquesta hipoteca.
La qüestió és que les entitats financeres que van comercialitzar aquest producte van ocultar part de la informació relativa a les previsions sobre l’evolució dels tipus de canvi i de l’impacte que això tindria en un deute tan gran i tan llarg com és el pagament d’una hipoteca.
En concret, el Tribunal Suprem les va qualificar el passat mes de juliol de derivats financers implícits, altament complexos, els riscos dels quals no són comprensibles per al comú dels ciutadans pel que van haver d’informar de quin podia ser el comportament previsible i probable del contracte segons les previsions que ells manejaven i, en definitiva, cuidar dels interessos dels seus clients com si fossin els propis.
Encara que ja no es comercialitzen, moltes víctimes encara no saben que poden emprendre accions judicials per intentar demanar la nul·litat de la seva hipoteca multi divisa.
